I’ve never had any problems paying the loan. Now I am ill and unable to work I decided to put in a claim for help, just until I can work again. Prior to this I have had two jobs and my total working hours amounted to 24. At Christmas I had to leave my main job (but not my other job) due to overwork, stress and other health complications caused by my main job. My health then deteriorated further and I had to go on sick leave from my second job. Since then I’ve had major surgery twice and now awaiting further procedures and then further major surgery. I filled in a claim form for help from the payment protection insurance and sent this together with a letter explaining in detail what had happened and that I have to be on sick leave as I’m too ill to work. After my final surgery I will be going back to work, so the payment help would only be for a short period of time, after which I would be able to continue my loan payments. I’ve received a letter back from the finance company this morning stating that they will not help me and that I needed to be working 16 hours or more to be able to claim, which I was! They only seem to be taking into account the hours of my second job as I had already left my main job when I claimed, yet I put all that in the letter.

Have any of you experienced this problem and what did you do, please?

I am so infuriated about this that I feel prepared to take things to the ombudsman. Firstly though I want to write to the finance company again and would appreciate your help if you have been through this.

Payment Protection Insurance is known for this sort of thing occurring. The CAB are currently running a campaign against precisely this issue.

The first thing to check is whether you were ever eligible for a payout. Talk to a CAB or financial advisor if possible, as they can give you practical advice. If you weren’t eligible you may be able to get some of your payments back for mis-selling.

If you were eligible and they are refusing to pay, then you need to write back to them, stating the position and that your claim was for the first job and not the second.

Also, regardless of whether you are eligible or not, contact the ombudsman and see if they can help. http://www.financial-ombudsman.org.uk/ Their website has advice on this.

write to the insurance company again letting them know of your intention to get in touch with the ombudsman, also state that you are giving them 14 days to reply to your letter, if they do not get back in touch then by all means get in touch with the ombudsman.

i found to my own cost a few years back that most of these policies are not worth the paper they are written on.

There are a lot of people right now reclaiming these protection plans costs (no win no fee type of cases) as in a lot of cases they have been missold. Try that route.
